Fla. Phlebotomist Sues Quest For OT Pay

Law360, New York (May 17, 2011, 6:20 PM EDT) -- A Florida phlebotomist launched a nationwide class action in Florida on Monday against Quest Diagnostics Inc., alleging the medical testing company failed to pay workers time-and-a-half for overtime.

In a lawsuit filed in Florida federal court, Deanna Holmes alleges Quest failed to pay her overtime wages for working more than 40 hours per week on several occasions between May 2008 and February 2009. She also alleges Quest's actions spread to all phlebotomists, who are classified as non-exempt under the Fair Labor Standards Act overtime requirements....
