6th Circ. Upholds $101M Verdict Against HCP

Law360, New York (May 17, 2011, 4:32 PM EDT) -- The Sixth Circuit on Tuesday affirmed a $101 million jury verdict against HCP Inc. for interfering with Ventas Inc.'s 2007 acquisition of Sunrise Senior Living Real Estate Investment Trust, and gave Ventas the opportunity to pursue punitive damages as well.

A three-judge panel for the Sixth Circuit rejected HCP's contention that Ventas' claims were barred by res judicata and that the Kentucky federal jury that rendered the $101.6 million verdict in September 2009 was issued improper instructions.
