1st Circ. Scraps Bag Fee Verdict For AA Porters

Law360, New York (May 20, 2011, 8:27 PM EDT) -- The First Circuit on Friday reversed a verdict in favor of nine American Airlines Inc. porters who claimed they lost out on tips when the airline imposed a curbside check-in bag fee in a case that also fueled a nationwide class action over the policy.

A three-judge panel ruled that the Airline Deregulation Act preempted the Massachusetts tips law under which the porters had brought their claims and were awarded $333,000. A nationwide class action building off the porters' verdict in Massachusetts was certified in February...
