Acer, Others Didn't Infringe Tessera IP: Fed. Circ.

Law360, New York (May 23, 2011, 5:33 PM EDT) -- The Federal Circuit on Monday affirmed a finding by the U.S. International Trade Commission that several dynamic random access memory chip manufacturers, including Acer Inc. and Nanya Technology Corp., did not infringe a patent held by Tessera Inc.

A three-judge panel for the appeals court also affirmed that Tessera's patents rights were exhausted because all the respondents bought chips from Tessera licensees. That finding provides a defense to Elpida Memory Inc., the only respondent found to infringe, the panel ruled.
