Duro Bag Can't Dodge Rival's Antitrust Suit

Law360, New York (May 25, 2011, 7:26 PM EDT) -- Duro Bag Manufacturing Co. on Tuesday lost its bid to toss a California suit that alleges it provided secret rebates and discounts to Western Pacific Kraft Inc. customers and interfered with vendor contracts, nearly driving its rival out of business.

U.S. District Judge Dean Pregerson ruled that Duro exerted anti-competitive pressure on WPK — which was both a competitor and a customer — by instituting a price squeeze that raised prices charged to WPK while simultaneously lowering prices charged to WPK's customers.
