Dow, Canada Settle NAFTA Pesticide Ban Dispute

Law360, New York (May 27, 2011, 5:51 PM EDT) -- Dow AgroSciences LLC has dropped its bid for $2 million in damages over a Quebec ban on certain pesticides in exchange for a public acknowledgement that when used correctly the chemicals don't pose unacceptable health or environmental risks, Canadian officials said Friday.

The U.S. chemical giant and the Canadian government reached the agreement on the two-year-old battle over Quebec's ban of certain uses of pesticides using a chemical called 2,4-D through the investor dispute settlement mechanism of the North American Free Trade Agreement, officials said....
