Occidental Wins Rehearing Of Peru Pollution Suit

Law360, New York (June 1, 2011, 6:44 PM EDT) -- The Ninth Circuit on Wednesday agreed to re-examine its order that overturned the dismissal of a suit alleging Occidental Petroleum Corp.’s exploration operations in Peru polluted waterways in the rainforest and injured the indigenous population.

Twenty-five members of Peru’s Achuar indigenous group filed the suit in May 2007, claiming the petroleum powerhouse used obsolete oil production methods for three decades, discharging millions of gallons of waste into northern Peruvian waters.
