Law360, New York (June 03, 2011, 9:39 PM ET) -- Philip Morris USA Inc. and R.J. Reynolds Tobacco Co. said Friday that they will appeal a Washington federal judge's ruling that she can preside over a racketeering case against them despite the U.S. Food and Drug Administration's new tobacco oversight duties.
The two companies, along with Lorillard Tobacco Co., gave U.S. District Judge Gladys Kessler written notice that they would appeal her Wednesday ruling that she still has jurisdiction over the Racketeering Influenced and Corrupt Organizations Act case, which has stretched on for 12 years....
