Law360, New York (June 06, 2011, 4:41 PM ET) -- Texas, Alabama and six other states asked the D.C. Circuit on Monday to strike down the U.S. Environmental Protection Agency's greenhouse gas regulations, saying the expansive rules violated the Clean Air Act.
The states argue that the EPA failed to consider the cost of compliance with three rules — the tailpipe rule, the prevention of significant deterioration interpretive rule and tailoring rule — that are designed to reduce carbon emissions from vehicles and stationary sources like power plants.
