BNSF, Dow Win $4.6M Over Calif. Cleanup

Law360, New York (June 10, 2011, 2:03 PM EDT) -- A federal judge on Wednesday ordered Brown & Bryant Inc. to pay $4.6 million to BNSF Railway Co. and Dow Chemical Co. to cover environmental cleanup costs at a California site where B&B formulated insecticides and other chemicals.

The suit revolves around a July 1993 order by the California Department of Toxic Substances Control that required Dow, BNSF and others to investigate and remediate contamination from herbicides, pesticides and other agricultural chemicals at a B&B site in Shafter, Calif.
