High Court Remands ACS Suit For Possible Arbitration

Law360, New York (June 13, 2011, 5:06 PM ET) -- The U.S. Supreme Court on Monday resurrected loan servicer Affiliated Computer Services Inc.'s hopes of forcing arbitration in a dispute with a debt-laden lawyer, following its determination that the Federal Arbitration Act preempts state laws invalidating class action arbitration waivers in contracts.

In light of its April ruling in AT&T Mobility LLC v. Concepcion, the high court sent the proposed class action over allegedly hidden penalties in student loans back to the Second Circuit for further consideration. The circuit court had upheld a lower court's ruling...
