Law360, San Diego (June 13, 2011, 4:22 PM ET) -- The Federal Circuit on Monday affirmed a $22 million verdict against Johnson & Johnson subsidiary Cordis Corp. for infringing Spectralytics Inc.’s patent covering a stent-cutting machine, but vacated the denial of Spectralytics’ bid for enhanced damages and attorneys’ fees.
A three-judge panel of the appeals court upheld a Minnesota district court’s judgment of validity, infringement and royalty rate for the damages measurement, but determined it applied the Federal Circuit’s 2007 decision in In re: Seagate Technology LLC in a more rigorous manner than was appropriate....
