Ex-AG Mukasey Tells Lawmakers FCPA Needs Reform

Law360, New York (June 14, 2011, 5:51 PM EDT) -- Former U.S. Attorney General Michael B. Mukasey told lawmakers Tuesday that the Foreign Corrupt Practices Act, the federal statute outlawing corporate bribery and corruption overseas, is unfair to businesses and needs to be overhauled.

"[T]he FCPA, as it is currently written and enforced, leaves corporations vulnerable to civil and criminal penalties for a wide variety of conduct that is in many cases beyond their control or even their knowledge," Mukasey said in prepared testimony before a panel of the House Judiciary Committee.
