Attys Lose Appeal Over Chemical Co. Settlement Fees

Law360, New York (June 15, 2011, 6:13 PM EDT) -- A California state appeals court on Tuesday affirmed a judge's decision to award $572,300 in uncashed checks from a personal injury class action settlement with General Chemical Corp. to a local charity rather than to three plaintiffs' attorneys.

The appeals court found the plain language of the settlement stated that the Richmond Children's Foundation would receive any uncashed checks, and that the deal did not specify that the plaintiffs' attorneys would receive contingent fees for so-called "shelter in place" claims.
