Law360, New York (June 17, 2011, 1:54 PM ET) -- Bank of America NA asked a California federal judge Thursday to throw out a putative class action that claims it forces tellers to work standing up, saying the plaintiffs haven't alleged that they wanted or even requested seats.
The bank also argues that civil penalties in the case could rise to $15 million, even though plaintiffs have not shown how they were harmed and were merely latching onto a wave of recent lawsuits in California.
