DC Circ. Won’t Force FDA’s Hand On Bid For BPA Ban

Law360, New York (June 17, 2011, 3:15 PM EDT) -- The D.C. Circuit on Friday refused to order the U.S. Food and Drug Administration to make a final decision on a petition by the Natural Resources Defense Council seeking a ban on bisphenol A in food packaging.

The dispute arises from a citizen petition that the NRDC sent to the FDA in October 2008, requesting a revocation of all regulations allowing the use of BPA, an endocrine-disrupting chemical, in products that could contaminate food.
