Law360, New York (June 22, 2011, 4:32 PM ET) -- E-Trade Financial Corp. asked a Texas federal judge Tuesday to toss a suit alleging the online brokerage firm infringed a patent for creating sales presentations on websites held by Constellation IP LLC.
An agreed motion to dismiss the suit, filed in the Eastern District of Texas, follows a reexamination and rejection of contested claims of the patent at issue by a US Patent and Trademark Office examiner. The rejection was upheld by the patent office's appeals board.
