5th Circ. Backs Dow Chemical In Retaliation Suit

Law360, New York (June 23, 2011, 9:22 PM EDT) -- The Fifth Circuit on Wednesday affirmed a win for Dow Chemical Corp. against claims it fired a longtime employee for complaining about the company’s alleged failure to pay overtime.

A three-judge panel ruled that a lower court was right to scrap a jury verdict and grant Dow judgment as a matter of law, finding little merit to the claim that Dow retaliated against Roy Maynor after he sought compensation for time spent studying for annual skills tests.
