Law360, New York (June 23, 2011, 4:25 PM ET) -- Two Liberty Mutual Insurance Co. subsidiaries requested summary judgment Wednesday in their Illinois lawsuit seeking to avoid covering the maker of Four Loko in underlying actions blaming the caffeinated alcoholic drink for deaths and injuries.
Netherlands Insurance Co. and Indiana Insurance Co. claim that liquor liability exclusions in their policies with Phusion Projects Inc. free them from defending or indemnifying the company in five suits in Florida, New Jersey and Illinois over the beverage, which was effectively banned by the federal government last year.
