Judge Boots Title Insurance Case To Arbitration

Law360, New York (June 28, 2011, 8:21 PM EDT) -- A California federal judge on Monday forced a group of antitrust class actions against a group of title insurers into arbitration, citing the U.S. Supreme Court's ruling in AT&T Mobility LLC v. Concepcion.

The high court decision, which nullified California state law against class action arbitrations in favor of more loose federal arbitration law, meant arbitration clauses in the insurance contracts in question were in force, U.S. District Judge Jeffrey White said.
