Fish Atty’s Hidden Friendship Sinks $22M Texas Award

Law360, New York (June 29, 2011, 4:44 PM EDT) -- A Texas appeals court on Tuesday threw out a $22 million award in a breach of contract arbitration because of a too-close relationship between the arbitrator and a Fish & Richardson PC attorney representing one of the parties.

The Fifth District Appeals Court said Fish & Richardson's Brett Johnson and JAMS Inc. arbitrator Robert Faulkner should have disclosed their decadeslong relationship when Johnson participated as counsel in a Faulkner-run arbitration session.
