Two Suits Added To OxyContin Antitrust Case

Law360, New York (May 24, 2007, 12:00 AM EDT) -- Two patent infringement suits have been added to the consolidated antitrust class action lawsuit filed over alleged inequitable conduct during the patent application process for the blockbuster painkiller OxyContin.

The suits, added Tuesday to the consolidated class action suit currently pending in the U.S. District Court for the Southern District of New York, were originally filed in Delaware by Purdue Pharma. In the suits, the drug maker accuses generic pharmaceutical company KV Pharmaceuticals Inc. of infringing three patents for Oxycontin.
