Law360, New York (July 05, 2011, 6:28 PM ET) -- The Tenth Circuit on Tuesday affirmed Butterball LLC's win in a proposed class action brought by workers at a turkey processing plant who claimed they should have been paid for time spent donning and doffing protective gear.
A three-judge panel affirmed a Colorado federal judge's decision to grant Butterball summary judgment, holding that putting on and removing poultry processing workers' personal protective equipment was "changing clothes" within the meaning of the Fair Labor Standards Act.
