BP, Anadarko Fight Over Spill Claim Arbitration

Law360, New York (July 7, 2011, 6:01 PM EDT) -- BP PLC and Anadarko Petroleum Corp. disagreed in Louisiana federal court on Wednesday over whether claims between them in the Deepwater Horizon oil spill multidistrict litigation should proceed, with BP arguing that their joint operating agreement for the Macondo Well forces them into arbitration.

BP insists that Anadarko’s cross-claims against it are subject to a mandatory arbitration clause in the agreement, while Anadarko contends that BP waived its right to arbitration by seeking discovery to link it to the rig explosion and ensuing disaster.
