Law360, New York (July 11, 2011, 3:22 PM ET) -- Qwest Corp. asked a Minnesota federal court on Friday to decertify the class in a Fair Labor Standards Act suit against it, citing the U.S. Supreme Court's recent ruling in Dukes v. Wal-Mart Stores Inc.
Qwest, which was acquired by CenturyLink Inc. in April, argues that to secure class certification under the Dukes ruling, class action claims must depend upon a common contention that can be resolved by determining the truth or falsity of the key issue.
