Court Shakes Head At FTC In Western-Giant Case

Law360, New York (May 29, 2007, 12:00 AM EDT) -- A federal district court has denied the Federal Trade Commission's request for a preliminary injunction barring the proposed $1.4 billion merger between Western Refining Inc. and Giant Industries Inc.

Judge James Browning of the U.S. District Court of New Mexico denied the agency's request to issue a preliminary injunction against the deal and dissolved a temporary restraining order on Western’s bid to buy out Giant, the companies said in a joint statement Tuesday.
