Law360, New York (July 15, 2011, 6:21 PM ET) -- Federal prosecutors on Thursday sought to disqualify Keker & Van Nest LLP from defending the ex-CEO of California’s SK Foods LP against charges that he fixed tomato prices because the firm also represents an ex-employee who will testify against him.
The interests of the former tomato magnate, Frederick Salyer, and the ex-subordinate who will testify against him, Mark Grewal, are “fundamentally adverse,” prosecutors said.
