ESA Suits Over Dam Operations Should Proceed: Judge

Law360, New York (July 18, 2011, 4:04 PM EDT) -- A magistrate judge in Maine on Friday advised keeping alive Endangered Species Act suits over dams that allegedly threaten to wipe out a population of Atlantic salmon.

U.S. Magistrate Judge John H. Rich III said that the Maine federal court should reject dismissal bids brought by defendants Topsham Hydro Partners Ltd. Partnership and Miller Hydro Group, who argued that they were pursuing Federal Energy Regulatory Commission permits that would allow them to continue operations.
