Ind. Court Says BP Gas Is Subject To Public Utility Regs

Law360, New York (July 18, 2011, 8:55 PM EDT) -- A state appeals court ruled Monday that BP Products North America Inc.'s transportation of natural gas to a tenant at its Whiting, Ind. refinery qualifies it as a public utility that must comply with state regulations for such operations.

The Indiana Court of Appeals' opinion partly reverses the Indiana Utility Regulatory Commission's decision finding that BP's delivery of natural gas to Marsulex Inc. did not qualify the energy giant as a public utility that must apply for a certificate of necessity.
