Law360, New York (November 19, 2004, 12:00 AM ET) -- Cereal maker Kellogg Co. has filed a lawsuit to overturn rival General Mills Inc.'s trademark on the phrase “cinnamon toast crunch” for a breakfast food bar.
General Mills, which already held a trademark for Cinnamon Toast Crunch cereal, asked the U.S. Patent and Trademark Office in 2000 to extend the use of that name to a food bar. Kellogg opposed the request, but a trademark appeal board ruled for General Mills in September.
