Law360, New York (July 22, 2011, 3:40 PM ET) -- A New Mexico federal judge on Thursday threw out a suit accusing Exxon Mobil Corp. and ConocoPhillips of conspiring to promote an allegedly anti-competitive new industry standard aimed at discouraging the use of biofuels.
U.S. District Judge James O. Browning found that plaintiff Plant Oil Powered Diesel Fuel Systems Inc., a manufacturer of vegetable oil-based diesel fuel, failed to allege the oil companies and the standard-setting body ASTM International had engaged in a plausible conspiracy.
