Law360, San Diego (July 22, 2011, 5:42 PM ET) -- The Federal Circuit on Friday affirmed the dismissal of Furnace Brook LLC’s suit alleging Aeropostale Inc., Nike Inc. and others infringed its patent for an interactive computerized catalog system, holding that the plaintiff had already fought the same claims against Overstock.com Inc. and lost.
In a 2-1 ruling, the majority held the Illinois federal court properly granted summary judgment that collateral estoppel blocked Furnace Brook from asserting its claims against the defendants.
