Law360, New York (July 28, 2011, 6:14 PM ET) -- A Tennessee federal judge overseeing the multidistrict antitrust litigation targeting the milk industry on Thursday decertified a subclass of dairy farmers who are members of primary remaining defendant Dairy Farmers of America Inc.
U.S. District Judge J. Ronnie Greer ruled that there was a conflict between the interests of DFA member farmers — who may well benefit from the supply agreements with the dairy cooperative that are challenged in the suit — and independent dairy farmers who form the other subclass in the suit.
