5th Circ. Revives Copyright Suit Over Coke Jingle

Law360, New York (August 2, 2011, 3:24 PM EDT) -- Finding that a lower court improperly dismissed the complaint as time-barred, the Fifth Circuit on Monday revived a Mexican composer's suit claiming that one of his songs was used without permission as the jingle for the 1990s "Always Coca-Cola" ad campaign.

The appeals court held that U.S. District Judge Lynn N. Hughes of the Southern District of Texas should have allowed plaintiff Omar Jaso to amend his suit against The Coca-Cola Co. to include allegations that would show his copyright and trademark claims were not barred...
