Law360, New York (August 03, 2011, 4:13 PM ET) -- The Eighth Circuit on Wednesday reopened a trade secrets battle between St. Louis-based drugmaker KV Pharmaceutical Co. and Spanish pharmaceutical company J Uriach & CIA SA stemming from a failed contract to jointly develop an antifungal cream.
KV filed suit in October 2009 in Missouri federal court, claiming Barcelona-based Uriach breached their contract and stole KV’s confidential information to launch its own version of the antifungal cream. The contract and trade secrets claims each sought at least $1 million in damages.
