CIT Tosses Challenge To US' Wage Rate Calculation

Law360, New York (August 3, 2011, 8:25 PM EDT) -- The U.S. Court of International Trade on Wednesday rejected Chinese producer Dorbest Ltd.'s challenge to the U.S. Department of Commerce's calculation of the labor wage rate in an anti-dumping probe over wooden bedroom furniture from China.

Chief Judge Donald Pogue affirmed the methodology behind Commerce's calculations and sustained the agency's redetermination on remand.

“The court finds that Commerce's methodology for calculating surrogate labor rate is affirmed. Judgment will be entered accordingly,” the ruling said.
