Gray Wolf Protections Slapped Down Again

Law360, New York (August 04, 2011, 7:21 PM ET) -- A Montana federal judge on Wednesday tossed two suits from environmental groups seeking to protect gray wolves, reluctantly authorizing the U.S. government's reinstatement of a 2009 rule that removed Endangered Species Act protection of the wolves in the northern Rocky Mountains.

In granting the U.S.' motion for summary judgment, Judge Donald W. Molloy also expressed his dismay at the method by which Congress acted to reissue the rule, which had been invalidated by a Montana federal court in 2010.  The rule violated the ESA by protecting...
