Britannia Loses Appeal Of €3.37M Zinc Cartel Fine

Law360, New York (June 7, 2007, 12:00 AM EDT) -- Britannia Alloys & Chemicals has again lost its bid to throw out a €3.37 million fine for its alleged involvement in a zinc cartel, with Europe's highest court upholding the penalty on Thursday.

The European Court of Justice upheld a ruling by the European Union's Court of First Instance, which had previously ruled that the European Commission was on target when it imposed the fine on the now-defunct Britannia, which has since been acquired by Anglo-Swiss mining group Xstrata Plc, the Commission said Thursday.
