Wal-Mart Sues US Over Chinese Pencil Duties

Law360, Los Angeles (August 10, 2011, 7:57 PM EDT) -- Wal-Mart Stores Inc. sued the U.S. Department of Commerce on Wednesday in the U.S. Court of International Trade alleging customs officials failed to use a customer-specific anti-dumping duty rate for pencils the retail giant purchased from three Chinese exporters.

Wal-Mart's suit claims U.S. Customs and Border Protection improperly liquidated shipments of Chinese cased pencils at a China-wide rate of 114.9 percent. The company argues that customs officials should have assessed the specific duty rates for the applicable period between Dec. 1, 2007, and Nov. 30, 2008....
