Foreclosure Fee Action Stays In Federal Court

Law360, New York (August 10, 2011, 8:09 PM EDT) -- A New Jersey federal judge refused Wednesday to send to state court a proposed class action accusing Mortgage Electronic Registration Systems Inc. of overcharging for foreclosure fees, holding that a state court's judgment did not cause the plaintiffs' alleged injuries.

Rosemarie Sheenan and James Sheenan III allege that after a New Jersey state court entered a foreclosure judgment against them in January 2006, defendants MERS, GMAC Mortgage LLC and GMAC Bank charged attorneys' fees and other expenses in excess of what the judgment awarded.
