EMI Wants Radikal's Case Thrown Out

Law360, New York (June 8, 2007, 12:00 AM EDT) -- EMI Music North America Inc. filed a reply Thursday in support of its bid to have an antitrust complaint lodged against it by Radikal Records Inc. thrown out with prejudice, arguing that Radikal's assertions lack the specificity necessary to sustain its case.

Attorneys for both sides are trading briefs ahead of a June 14 hearing on EMI's pending motion to dismiss.

The amended complaint Radikal filed on March 14 is “poorly drafted” and “inadequate,” according to Donald Zakarin, the Pryor Cashman partner who signed the reply...
