Judge Won't Certify Class In Chicago Title Fee Fight

Law360, New York (August 16, 2011, 8:43 PM EDT) -- A Washington federal judge on Monday denied certification for a proposed class of mortgage holders accusing Chicago Title Insurance Co. of refusing to refund reconveyance fees associated with home refinancing.

U.S. District Judge James L. Robart ruled that named plaintiffs Mark and Raelene Bushbeck failed to show that common claims predominated in the suit, which claims breach of good faith and fair dealing along with violations of the federal Real Estate Settlement Procedures Act and the Washington Consumer Protection Act.
