CyberSource Credit Card IP Invalid, Fed. Circ. Affirms

Law360, New York (August 16, 2011, 3:58 PM EDT) -- The Federal Circuit on Tuesday affirmed a lower court decision that two claims of a CyberSource Corp. patent for an online credit card fraud detection method were invalid, ruling that the claims attempt to capture “unpatentable mental processes.”

A three-judge panel issued a 21-page precedential opinion affirming a district court judge's ruling that granted accused infringer Retail Decisions summary judgment on invalidity with respect to the two patent claims, for failure to recite patent-eligible subject matter.
