3rd Circ. Calls Conoco Asbestos Exposure 'Serious'

Law360, New York (August 16, 2011, 7:24 PM EDT) -- The Third Circuit sided Tuesday with the secretary of the U.S. Department of Labor in an interagency dispute over what constitutes a “serious” asbestos violation, ruling that three ConocoPhillips workers were exposed in a manner that warranted the designation.

In a precedential ruling, a three-judge panel remanded the violations to the Occupational Safety and Health Review Commission — which had determined Conoco's violations were “not serious” — with instructions to rule they were serious.
