Daimler Sues Carmakers Over Smart Car Design IP

Law360, New York (August 17, 2011, 10:33 PM ET) -- Daimler AG sued Shuanghuan Automobile Co. Ltd. and Wheego Electric Cars Inc. in Michigan federal court on Wednesday, claiming the carmakers infringed patented and trademarked designs to produce "blatant knockoffs" of Daimler's smart fortwo automobiles.

Daimler claims the vehicles manufactured by Shuanghuan and Wheego are virtually identically designed as Daimler's smart fortwo subcompact cars and are damaging the smart fortwo design and brand in a suit alleging trademark counterfeiting and dilution, as well as trademark and patent infringement, in violation of the Lanham Act.
