Mister Softee Tries To Freeze Rival's Use Of Jingle

Law360, New York (August 22, 2011, 11:53 AM EDT) -- Ice cream truck company Mister Softee Inc. filed a trademark and unfair competition suit Friday in Arizona federal court, alleging Phoenix-based rival Mister Frosty uses Mister Softee's famous jingle without authorization.

According to the suit, Mister Frosty operator Nidal Awawda's use of the jingle is misleading customers and harming Mister Softee franchisees that pay royalty fees for the right to play the song over the speakers on their trucks.
