3rd Circ. Tosses Ex-Pa. Lawmaker's 4 1/2-Year Sentence

Law360, New York (August 23, 2011, 7:20 PM EDT) -- The Third Circuit on Tuesday threw out the 55-month sentence of former Pennsylvania state Sen. Vincent Fumo, ruling that a district judge erred in calculating the corruption sentence.

The appeals court agreed with prosecutors that U.S. District Judge Ronald Buckwalter failed to explain why the sentence he imposed fell far below federal guidelines for Fumo's crimes, which include defrauding the state Senate, a museum and a nonprofit of millions of dollars.
