Law360, New York (August 23, 2011, 6:55 PM ET) -- A Missouri federal judge reaffirmed Tuesday that Monsanto Co. must produce documents related to the reissue of a seed gene patent in its suit alleging DuPont Co. unlawfully incorporated the gene into its own herbicide-resistant seeds.

U.S. District Judge E. Richard Webber said that despite Dupont's liberal interpretation of his previous order requiring Monsanto to waive attorney-client privilege and produce materials related to its patent reissue application, Monsanto still must come up with information about the significance of an international Patent Cooperation Treaty application on the...
