1st Circ. Won't Hear Same-Sex Benefits Suits En Banc

Law360, New York (August 23, 2011, 7:03 PM EDT) -- The First Circuit decided Tuesday that three consolidated cases in the appeals court challenging the Defense of Marriage Act as part of a dispute over health benefits for federal workers in same-sex marriages would not be heard en banc.

The lawsuit arose after the U.S. Office of Personnel Management, which oversees the federal civil service, denied health benefits for legal same-sex spouses of government employees, including one who worked at the U.S. Postal Service and one who formerly worked at the U.S. Social Security Administration....
