Panel Probes Public Release Of $35M Massey Settlement

Law360, New York (August 23, 2011, 8:03 PM ET) -- A panel of West Virginia judges convened Tuesday to probe the public disclosure of a $35 million settlement between Massey Energy Co. and hundreds of residents in the state who claimed the company damaged their property and health by tainting groundwater with coal slurry.

Lawyers for the parties said in late July that the parties had settled for a confidential amount, but in early August, the Associated Press published details from a private letter sent to the plaintiffs that disclosed Massey’s offer.
